An expunction is a lawsuit filed that requests a District Court to grant an order for all law enforcement agencies, which possess a person’s records of arrest, to delete and destroy these records. The purpose of an expunction is to remove any and all criminal records that a law enforcement agency and public records keeping companies, like publicdata.com, may keep. This petition can be extremely beneficial to anyone who has ever had a criminal record and would like to make these records not accessible, especially for employers.

A Non-Disclosure order, also known as a confidentiality agreement, is a petition that can be filed for an individual who has plead guilty or nolo contendere (not contest) to a criminal charge. The individual must have received deferred adjudication community supervision by the courts. The petition for non-disclosure must be filed in the court that placed the person on deferred adjudication community supervision. The petition for non-disclosure does not erase the person's records; it simply restricts access to the records to a limited number of law enforcement and state agencies.

It is very important to know the differences between these two petitions so that a person may know what opportunities they may have. If an individual is eligible for an expunction or non-disclosure, these options can greatly improve a person's future employment opportunities and credit related matters, such as housing. Wyde & Associates is experienced and willing to assist a client with either of these procedures, as long as a client qualifies.
